Please read the information posted below before asking to place a deposit on a puppy. Once you have requested to move forward with placing a deposit we will send you a copy of this agreement filled out and you will have two hours in which to return the deposit agreement and place a deposit.

The buyer understands that if the Holding fee is not received electronically via Zelle or Venmo within 2 hours of the receipt of the Holding fee agreement, the agreement is considered null and void.
** This puppy is being purchased as a pet only and is not to be bred for any reason. Buyer agrees that the puppy will be spayed/neutered by 6 months of age under the terms and conditions found in our Health Guarantee/ Sales Contract. We no longer offer AKC registration on pet puppies.

The Holding Fee is placed under the following terms and conditions:
Purpose:
The purpose of the non-refundable holding fee is to reserve the puppy for the buyer, and the breeder will desist advertising the puppy once the non-refundable holding fee is received. Therefore, the non-refundable holding fee will not be returned/refunded due to the potential loss of buyers and the additional money/time to re-advertise the puppy- EXCEPT under the following circumstances:
The breeder can cancel or refund at any time if the breeder determines that the sale is no longer in the best interest of the puppy. If the puppy were to pass away in the breeder's care, the buyer would have an option to get a cash refund or to transfer the holding fee to another puppy. Suppose the buyer chooses the cash refund buyer agrees that the breeder has 21 days to issue the refund. In that case, the buyer understands that they are purchasing a puppy from a hobby breeder, and funds may not be readily available. If a puppy were to be diagnosed with a life-threatening genetic defect during their vet check, the buyer would also have the option of a refund or transferring their holding fee to another puppy. Suppose the buyer chooses the cash refund buyer agrees that the breeder has 21 days to issue the refund. In that case, the buyer understands that they are purchasing a puppy from a hobby breeder, and funds may not be readily available.
**Please note: Any of these three cases would be highly unusual, but puppies are living animals, and even with excellent care, things do happen. The purpose of this contract is to protect both parties and ensure we have covered circumstances to the best of our ability. Aside from the three circumstances listed above, no other money will be returned at any time for any reason.

Buyer understands that if a deposit is not received within 2 hours of deposit information being sent, this contract is considered null and void.

Our health guarantee does explicitly not cover umbilical hernias, tight nostrils during teething or soft spots ( on the top of the head of young or tiny puppies). The buyer agrees to research the common breed tendencies and Shih Tzu puppy development. Please read the Health and breed tendencies on our website: http://www.beautystinyshihtzu.com/healthbreed-tendencies.html. The breeder has no way of knowing if a puppy will eat its stool or develop an umbilical hernia. While most of these developmental issues will be outgrown as puppies mature, your vet may want to repair an umbilical hernia at the time of spay/neuter. If this is the case, the nominal cost ( under $100) will still be the buyer's responsibility. No money and no refunds will be returned for any of these common breed tendencies.
Vet and Health care while the puppy is with us
Before going home, puppies will be seen by our vet and up to date on shots, worming, and flea prevention ( seasonal). Puppies will be eating well, and poop will be "solid" before puppies are allowed to go to their new homes. Even as much as we have wormed them, giardia and coccidia are opportunistic parasites that may come out due to the stress of traveling/ being in their homes. The buyer is aware that puppies may need an additional wormer/ worming treatment in their new homes.

Size/ Color/ Potty training:
Size
We breed more for body type than the weight itself. We try to produce a well-proportioned dog- with the length of legs and back also contributing to overall size- not just weight. We try to give buyers' size estimates at the time of placing their non-refundable holding fee agreement, which is based on the weight chart, growth rate, size of parents, grandparents, known relatives, and past litters. Most of our puppies mature in the estimated size range or very close to, but we can not guarantee size. Obviously, as puppies grow, this will become easier, and we often offer the very tiny puppies for deposit closer to 8 weeks which gives the buyer a better chance of the puppy maturing to be the estimated size. Body type, metabolism, diet, exercise are examples of why this is out of our control- no different than you can predict the "weight" of your own children/grandchildren/family, etc. If weight is significant to you, we suggest purchasing an older puppy or even an adult instead.
Color: Shih Tzu typically lightens with age- some change considerably. For example, gold and white may appear to the uneducated eye as black and white at birth, but as an adult could be as dark as a light red and white to as light as a very soft cream and white. Typically, the undercoat is lighter, so most Shih Tzu will look lighter in a haircut. Genetics play a significant factor in color as most Shih Tzu carries the fading gene. We have some puppies who have retained their adult color into adulthood, and if you are looking for a darker puppy, these are the best choices to get a puppy from, but color can still never be guaranteed.
Potty Training/ Crate training:
From the time our puppies can crawl, we begin working with them on potty training, trying to train them not to go potty, where they eat/sleep, and to use potty pads, and by the time they go home, they are typically about 80% successful using potty pads in a confined area. We ask that buyers purchase an Iris or potty pen and continue with training in their new homes for the best success. If a buyer would like to start puppy on Crate training, we ask that puppies not begin crate training ( where they are enclosed for more than 1 hour) until 13 weeks or later due to the small bladder size of Shih Tzu. Shih Tzu do best with positive reinforcement, and negative reinforcement can lead to submissive urination and additional potty training issues. Buyers must continue potty training in their new home. We do not guarantee potty training. While we breed for trainable dispositions, we can not guarantee the training of any kind, and buyers may need to seek professional training assistance.

Updates
Due to scammers and picture theft, all images are watermarked, so it is time-consuming to groom/bathe, do pictures/video, and watermark pictures to be able to share. Remember, providing quality care and socialization is our priority- you will have plenty of time to take pictures and video when your new baby gets home to you! We update photos OR videos every two weeks while puppies are with us.
The Internet and Puppy Sales: While we maintain a website and online presence, we do not feel we sell/adopt our puppies electronically. We require a phone interview to ensure our puppies go to the best homes for them and we are the right breeder for you. The internet has many benefits, but there are also downfalls. The internet allows one to spread information very quickly and possibly in a permanent and very damaging way. As breeders, we strive for perfection, but every dog will have flaws, just like we do as people. Not all puppies will mature the way we hope to develop, and there is the possibility of defects. Ultimately Mother Nature has the final say. Suppose you choose to circulate negative information about our breeding program. In that case, the puppy you have purchased, us as breeders, etc., on any public forum, your contract will be considered null and void, and we may consider legal action for slander. Should there be a problem with your puppy, the buyer and the puppy breeder ( ourselves) will try to resolve the issue most civilly and maturely. Neither the puppy buyer nor the breeder will publicly post anything about this issue.
Payment:
The holding fee of at least 1/3 of the puppy's purchase price will be applied towards the purchase price when the puppy is ready to go. Final payment will be paid upon pick up in cash. The contract will terminate for non-payment of all monies due that are not received by the agreed-upon time. Monies are non-refundable if the purchaser cancels for any reason. Purchaser forfeits all money paid if the agreement is terminated for non-payment.
Sellers always reserve the right to refuse sale at any time.
Transfer:
We do not offer refunds under any circumstances other than outlined in this contract above; however, we will transfer your deposit to another puppy under the following circumstances:
If the puppy is under four weeks of age, you can transfer the non-refundable holding fee to another puppy with no penalty.
If the puppy is between the ages of 4-7 weeks, the non-refundable deposit can be transferred to another puppy; however, 30% of the original puppy's purchase price will be deducted from the amount transferred because the original puppy will now need to be re-advertised and may need to be discounted. The transfer is for emergencies only. AFTER 8 weeks, your payment cannot be transferred and will be forfeited unless you complete the final purchase.
For out of state buyers:
Out of state buyers are always welcome to fly into CA and meet us at our home or meet at the airport. We offer Facetime to ensure that our out-of-state buyers can see the puppy live if desired. If delivery is still needed, we can contact our puppy nanny on your behalf to deliver the puppy to your local airport due to puppy nannies' busy schedules. The buyer will need to pay the final cost no later than eight weeks. The purchase price does not include shipping. Nanny's fees are paid directly to the nanny when you receive your puppy. Our puppy nanny and we do our best to get to you as fast as possible. Still, the buyer understands that nannies fly standby and have no control over flight schedules. At the same time, we try to accommodate the nannies' schedules as well as we can. We also have families/dogs/ work obligations and may not be available at the first available time. Buyer understands that flying is tiring and can be stressful on puppies and understands that they will need to give puppies at least a total of 24 hours to rest and acclimate before the puppy goes to the vet, and visitors need to be kept to a minimum. The buyer needs to have all supplies on hand ( including Karo syrup/Nutrical) if the puppy goes off their feed initially to prevent hypoglycemia.
Delivery:
We may offer fast delivery ( typically for an additional charge- please ask us for a quote) in CA. Puppies will need to be paid in full if delivery is desired, as we will provide delivery on a completed sale only.

Taking your puppy home
Before puppies are allowed to go home, new puppy owners have agreed that they have the following supplies: Food/ foods the puppy is eating Iris pen (s) or similar type of playpen Potty pads Vet checked must be scheduled within four business days! The buyer has been given a supply list, and all other supplies are at the buyer's discretion, but we will no longer let puppies go home if they do not have their food/playpen/ potty pads purchased and set up in their new home.
Puppies are generally ready to go home ( for in-person or delivery) at nine weeks. Breeders always determine when puppies are ready to go home as their safety comes first! We will let you know if we do not anticipate a puppy needing to be with us longer than nine weeks. If puppies are ready at nine weeks, they must be picked up by ten weeks; otherwise, we charge a boarding fee of $20.00 per day, and the puppy must be paid for in full. If you are not picking up your puppy until ten weeks, payment in full is due by eight weeks.
We do not want to board puppies. If you are going away for a trip, business, etc., and will not be able to take the puppy by ten weeks of age, these arrangements must be made prior to placing a deposit. At that time, we will let you know if we are still able to accept a deposit or you will need to wait until another litter.
If puppies are not ready to go home at nine weeks ( too small, not eating well enough, etc.), you will still need to pay in full by eight weeks; however, the only additional charge will be for extra shots/vet care if the puppy is still with us when the following shots are due, and you will receive a receipt for any additional vet care the puppy may need prior to going home.
If a credit card/ Paypal or any other payment method is used other than cash and there are any additional fees, the buyer is responsible for them. Paypal/credit card can be used for non-refundable holding fees only. For in-person buyers, only cash is accepted at the time of pick up.
All payments must be received and clear before the puppy is ready to go home. We only accept cash at the time of pick up. We do not carry personal checks at any time.
Seller assumes no shipping costs associated with the sale or replacement warranty.
The puppy must be taken to the vet within four business days in order to activate the health guarantee. If the buyer fails to take their puppy to the vet, the health guarantee will be considered null and void. Parvo is highly contagious! Puppies will not be taken to public places until shots are completed, including groomers and puppy training classes. Puppies will need to be transported in a secure carrier and not allowed to be touched by people at the vet ( except vet/vet tech) who have properly sanitized their hands.

Puppy is purchased under the following additional conditions, which will be detailed in our health guarantee:
-The purchaser agrees to have the puppy spayed or neutered by the age of 6 months old, provided the puppy is big enough as supported by your vet in writing. If the puppy is not big enough to spay/neuter at six months, the breeder must be notified in writing. Further details are outlined in the sale contract.
-Copies of parent's pedigrees are available upon request after proof of spay/neuter. We will only be registering litters that we are keeping puppies back out of otherwise
- If the breeder cannot produce the puppy due to death or other unforeseen circumstances, the buyer has the option to pick another puppy of equal value (value determined by breeder) OR a refund as detailed in the previous section of this contract. The breeder has up to one year to replace the puppy. Our Sales Contract/ Adoption form outlines all other terms and conditions, and the purchaser agrees to them. Written name of buyer:
